No-Fault Collection
We help New York healthcare providers recover the no-fault insurance benefits they have earned — through arbitration and, where needed, litigation.
When a no-fault insurer denies, delays, or underpays a valid claim, your accounts receivable sits frozen. And because a provider who treats a no-fault patient generally looks to the insurer rather than the patient for payment, an unpaid claim can quietly turn into a real loss. Our firm pursues what you are owed so you can stay focused on patient care.
For over a decade we have recovered substantial sums in unpaid no-fault benefits for healthcare providers across New York. We tailor our approach to each practice and to the facts of each claim, and we pursue every matter through the path most likely to get you paid.
Providers we represent
We collect unpaid no-fault benefits for the full range of healthcare providers, including:
- Physicians and medical practices
- Chiropractors
- Acupuncturists
- Physical and occupational therapists
- Psychiatrists and psychologists
- Diagnostic and imaging facilities
- Ambulatory surgical centers
- Durable medical equipment (DME) suppliers
Why valid claims get denied — and how we respond
Insurers raise a familiar set of defenses to avoid or reduce payment. We are experienced in answering each of them:
- Alleged failure to appear for an independent medical examination (IME)
- Peer-review denials questioning the treatment provided
- Assertions of a “lack of medical necessity”
- Late notice or alleged untimely submission of a claim
- Failure to appear for an examination under oath (EUO)
- Reductions or down-coding under the applicable fee schedule
- Disputes over exhaustion of the available coverage
Arbitration or litigation — choosing the right path
New York provides a dedicated arbitration process for no-fault disputes. Arbitration is generally faster and more cost-effective than court, and for many denied claims it is the most efficient route to payment. When the amount at stake, a recurring insurer practice, or a complex legal question makes court the better forum, we litigate.
If an arbitration award is unfavorable, the no-fault system also allows a further review through master arbitration, and we pursue that step when it is warranted. We recommend the path that fits your claim — not a one-size-fits-all process.
Beyond collections: additional services for providers
Recovering denied claims is often only part of the picture. We also help healthcare providers protect their revenue and respond when an insurer turns the tables.
We assist providers with:
- Preparation and defense for examinations under oath (EUO)
- Responses to insurer audits and refund or recoupment demands
- Peer-review and medical-necessity disputes
- Affirmative litigation against carriers — including civil RICO actions where an insurer’s claim practices warrant it
- Billing, documentation, and compliance review
How we recover your claims
- 1
Claim review and assignment
We review your denied, delayed, or underpaid claims and take an assignment of benefits so we can pursue the insurer directly.
- 2
Demand and documentation
We assemble the billing, treatment records, and proof of mailing that a carrier must answer, and we press for payment.
- 3
Arbitration or suit
We bring your claim in the designated no-fault arbitration forum or in court — whichever gives you the better result.
- 4
Hearing and award
We present your case and pursue the full benefits owed, together with statutory interest and attorney’s fees.
- 5
Enforcement and appeal
We enforce favorable awards and, where appropriate, pursue master arbitration or further review.
Frequently asked questions
Can I bill the patient for a denied no-fault claim? +
Generally no. When a provider accepts an assignment of benefits, the provider looks to the insurer — not the patient — for payment. That is precisely why pursuing the carrier matters.
What is an assignment of benefits? +
It is the patient’s written authorization that lets the provider stand in the patient’s place and collect no-fault benefits directly from the insurer.
How long does the no-fault process take? +
Arbitration is generally faster than court, but the timeline depends on the forum and the issues in dispute. We move every claim as efficiently as the process allows.
What happens if the insurer ignores an arbitration award? +
A no-fault arbitration award is enforceable. If a carrier fails to honor a favorable award, we take the further legal steps needed to enforce it.
How do you charge for collection work? +
We offer several service arrangements and will discuss the approach that makes the most sense for your practice. Contact us to talk through the options.
